Pedro Duvall, one of the finalists in the Portuguese preselection for the 2009 was disqualified today following accusations that Sinto sentido was in breach of the EBU rule which states that a song cannot have been publically performed before October 1st.

Acording to José Poiares , the head of the portuguese delegation during the online voting to choose the finalists to festival da cancao, RTP got an email claiming Pedro Duvall's song wasnt an original song and was also presented during a charity show before October, there fore didnt follow Ebu's rules to take part at the Eurovision song contest.

At the time RTP didnt take any decision cause any real proove of the fact was presented in the email. RTP asked for detail information and any proove that could be taken in consideration to desqualify a contestant.

Only when the 12 songs were already chosen the author of that email send the prooves requested by RTP.

RTP had to take all the steps necessary to make a detailed avaluation of what was presented and also asked the opinion of Ebu, even if Ebu doesnt that part at any decision concerning National finals. Even so the fact that if Pedro Duvall's song ''Sinto sentido'' would be chosen as the portuguese representative to Moscow the song , if confirmed not following Ebu's rules it could be disqualified.

After a metting with the singer wich confirmed the facts presented, RTP decided to disqualified the song there for the semi finalist that was 13th on the online voting, Nuno Norte with the song '' Lua sem Luar'' replaces Pedro Duval in this years edition of Festival da Cancao.
