esctoday.com has been in touch with RTVE in Spain regarding one of the songs selected by the specialist jury to participate in the Spanish national final. The song Mourning by Null System is available to download on itunes on the Ready 2 burn album. According to publication information on the itunes store, it has been available since 10th July 2007.

After receiving dozens of emails today regarding this information, esctoday.com has presented them to TVE and they are investigating the situation. If proved to be correct, it means that the song would break the rules of the Eurovision Song Contest which clearly state that a song cannot be performed or commercially released before 1st October 2007.

The spanish national broadcaster has confirmed to esctoday.com that they are now investigating situation and will confirm in the near future what action will be taken should the song breach the rules. Over 500 were submitted for the jury to chose from, all of which were submitted with forms claiming the songs were not available, performed or commercially released prior to the date imposed by the EBU.
